Job Description

MINIMUM REQUIREMENTS 1. Academic Qualification A Four year Labour Relations, Labour Law or Industrial Relations qualification with 480 Credits on a NQF level 8. 2. Experience: At least three years relevant specialised experience in an employment relations environment. 3. Knowledge and Skills • Proven knowledge of South African labour legislation; • Understanding and experience of the following ER processes and procedures ? CCMA, and Labour Court procedures; ? Advanced knowledge of facilitation, mediation, conciliation and arbitration procedures; ? Collective bargaining, negotiations and collective agreements; ? Conflict dispute resolutio • Knowledge of employment contracts and employment labour law; • Knowledge of labour economics and remuneration principles. • Advanced knowledge of facilitation, mediation, conciliation and arbitration procedures. • Problem solving and communication skills. 4. Recommended: • Exposure to ER practices in a Higher Education environment; • A relevant LLB qualification. 5. Critical Key Performance Areas 5.1 Employment relations consulting/coaching ? Build and maintain constructive relationships with line managers, staff, internal and external ER partners; ? Advise and coach line managers and staff on the interpretation, application and implementation of HR policies/procedures/processes/systems pertaining to: ? Employment Relations policy and procedures; ? Grievances and disciplinary procedures; ? Dispute resolution; ? Implementation of collective agreements; ? Monitor and evaluate the relationship between staff and management; ? Monitor the implementation of Employment Relations policy and procedure and ensure compliance to legal requirements; ? Facilitate the preparation of cases for pre arbitration, CCMA and Labour Court; ? Representation at CCMA and facilitate Labour Court cases; ? Ensure capacity building and training of line managers in Employment Relations. 5.2 Implementation of ER policies, procedures and collective agreements ? Interpret the collective bargaining agreement with regard to salaries, benefits, employment relations practices and other contractual stipulations. ? Assist in compiling the annual negotiation schedule. ? Assist in preparation/information gathering during collective bargaining: ? Obtains, compiles and provides supporting information relating to affordability, economics/costs, comparisons with local or national market or tertiary institutions, staff and salary statistics; ? Updates cost calculations as negotiations progresses based on management’s mandate and unions’ demands. ? Keep abreast of latest labour legislation developments and provide relevant advisory services to employees and management. ? Provide pro-active advice to management based on trends analysis and best practices. ? Implement collective agreements. ? Coordinate all collective engagement structures. ? Advises on the implementation of employment and CCMA awards and agreements. ? Conduct research into Labour/Employment Relations trends, awards and national issues and update advice given to the institution. 5.3 Implementation and management of Dispute Resolution Processes ? Advise on preventative conflict resolution strategies to minimise or prevent referrals. ? Facilitate fair service conditions which are defined and agreed upon by all relevant stakeholders ? Counsel labour and/or managers to prevent or resolve disputes over collective agreements or other IR related issues. ? Scheduling of Grievances and Disciplinary Hearings ? Advise on legally correct procedures during grievances and disciplinary hearings ? Advise and support staff on their rights in the event of grievances and disciplinary procedures.
