The Office of the Ombud for Financial Services Providers (FAIS Ombud) is pleased to announce an exciting vacancy for a Junior Adjudicator. FAIS Ombud Junior Adjudicator Job Purpose:
- Drive the resolution of complaints received by FAIS Ombud from the public against financial service providers.
 - Work within a target-driven environment to resolve complaints procedurally fair, informally, economically, and expeditiously.
 
Requirements:
- Educational Background:
- Matric certificate.
 - Bachelor’s degree in law (LLB/BCom).
 - Post Graduate Degree in Financial Planning (advantageous).
 
 - Experience:
- 1 – 2 years’ experience in financial services and/or customer complaints management.
 - 1 – 2 years’ experience in legal drafting.
 
 - Knowledge and Skills:
- Understanding of the legal environment of FAIS Ombud’s operations.
 - Thorough knowledge of the FAIS Act, 37 of 2002, and subordinate legislation.
 - Ability to make market conduct arguments across various financial sectors.
 - Fluent in English and one other official language.
 - Strong report writing skills, capable of expressing complex concepts.
 - Familiarity with Microsoft CRM Programme (or similar) beneficial.
 
 
Key Performance Areas
- Review each complaint in detail to understand the underlying issues and grievances.
 - Identify relevant legal principles and precedents applicable to each case.
 - Develop clear and concise resolution strategies that align with the principles of fairness and justice.
 - Ensure that all conclusions are well-supported by factual evidence and legal reasoning.
 - Gather and examine all relevant documentation and evidence related to each complaint.
 - Assess the validity of arguments presented by both the complainant and the financial service provider.
 - Interpret and apply contractual provisions and relevant legislation, including the FAIS Act.
 - Balance legal considerations with principles of equity and fairness to reach just outcomes.
 - Draft comprehensive and well-reasoned written recommendations for the resolution of complaints.
 - Ensure that all recommendations are clear, logical, and based on sound legal analysis.
 - Adhere to established timelines to provide timely resolutions for all cases.
 - Maintain a high standard of written communication to convey complex legal concepts effectively.
 - Communicate effectively with complainants, financial service providers, and other relevant parties.
 - Foster positive working relationships with stakeholders to facilitate smooth complaint resolution.
 - Collaborate with internal teams to ensure consistency and accuracy in the handling of complaints.
 - Participate in discussions and negotiations to reach amicable settlements where possible.
 - Stay updated on the latest developments in financial services law and related fields.
 - Perform in-depth legal research to support the analysis and resolution of complaints.
 - Identify and present multiple legal options and approaches for resolving disputes.
 - Ensure that all legal advice and options are practical, reliable, and in compliance with regulatory standards.
 - Represent FAIS Ombud at various meetings, conferences, and events.
 - Prepare and deliver presentations on relevant topics to internal and external audiences.
 - Engage with media representatives to provide accurate information and enhance the visibility of FAIS Ombud.
 - Act as a spokesperson for FAIS Ombud, ensuring clear and consistent messaging.
 - Prioritize and manage a diverse caseload to ensure timely and effective resolution of complaints.
 - Implement best practices in case management to enhance efficiency and productivity.
 - Maintain a customer-focused approach, ensuring that complainants feel heard and respected throughout the process.
 - Monitor and report on the progress of cases to ensure accountability and transparency.
 - Adapt to various tasks and responsibilities as needed to support the overall mission of FAIS Ombud.
 - Demonstrate flexibility and a willingness to take on additional responsibilities.
 - Contribute to the continuous improvement of FAIS Ombud’s processes and procedures.
 - Participate in training and development opportunities to enhance professional skills and knowledge.
