Job Requirements
Educational Qualifications
- An LLB or a degree in law (NQF Level 7) as recognized by SAQA.
- Admission as an Advocate or Attorney is advantageous.
Experience
- A minimum of 8 years of relevant post-qualification experience in legal services and litigation.
Licenses and Skills
- Valid, unendorsed driver’s license.
- Expert knowledge in:
- Court processes, administrative and constitutional law.
- Law of evidence, labor law, law of delict, criminal law, and criminal procedure.
- The South African legal system and public service legislation.
- Public Finance Management Act (PFMA), PAIA, PAJA, and IPID mandates.
Competencies
- Leadership and stakeholder management.
- Legal interpretation and understanding of legislation and policies.
- Litigation, arbitration, and alternative dispute resolution.
- Proficiency in communication (verbal and written), research, negotiation, and project management.
Job Responsibilities
1. Legal Advice and Opinions
- Conduct research on policy, legislation, and legal principles.
- Provide well-reasoned written recommendations and conclusions.
- Consult stakeholders for legal administrative interventions.
2. Litigation and Labour Arbitration
- Manage court and arbitration cases from inception to conclusion.
- Review pleadings and explore alternative dispute resolutions.
- Advise the department on whether to litigate or defend legal matters.
3. Drafting and Vetting Contracts/SLAs
- Draft, negotiate, and vet contracts to ensure compliance with legal standards.
- Protect the department from legal risks associated with contractual obligations.
4. Legislation and Policy Review
- Provide legal guidance on policy and legislative developments.
- Liaise with stakeholders to gather and disseminate required information.
5. Administrative Duties
- Contribute to strategic planning and operational execution within the unit.
- Submit regular performance reports and manage contingent liabilities.
